(2) Use of the web site by the user

The North Ayrshire Council has no responsibility for or liability with respect to the users equipment.
(b) The user will ensure at all times that its use of any web page including connection of the users equipment to the web site is in accordance with all applicable Data Protection and other laws, licenses, codes of practice or regulations.
(c) The information and services are provided subject to the condition that there will be no abuse or fraudulent use thereof. Abuse and fraudulent use of the said information or services shall include (without limitation):-

Attempting to, or actually obtaining, accessing, altering or destroying the
data files, programmes, procedures and/or information of the web site or of
another user of the web site.
(ii) Assisting another to perform the act prohibited in (i) above.
(iii) Using the information or services in such a manner as to
interfere unreasonably with the use of the services by any other user or authorised

(d) The user acknowledges that neither the internet nor the web site is secure and accordingly North Ayrshire Council cannot guarantee the privacy of any of the users information unless the user uses encryption software.

Users undertakings.
The user undertakes for itself and for any other party using its access to
the web site:-
a) Not to create or/introduce into the web site any viruses, worm, trojan horse, cancelbot or other destructive or contaminating programme or advise any other party how to do so:
b) To use an up to date virus scanning programme on all material downloaded from the web site or web page.
c) Not to send any message, e mail or communication which:-
(i)
Is in breach of any laws, codes or regulations including, infringement of
copyright and other intellectual copyrights, defamation, theft, fraud, drug
trafficking, money laundering and terrorism.
(ii) May incite violence, sadism cruelty or racial hatred.
(iii) May facilitate prostitution or paedophilia.
(iv) Is pornographic, obscene, indecent, abusive, offensive or menacing.
(d) Not to invade the privacy of other users of the web site or the internet in general including sending unsolicited e mails (spamming) nor to collect or transfer personal data on individuals without their consent.
(e) To maintain confidentiality of its log in names, passwords and other confidential information related to the users access to the web site.
(f) Not to tamper with routing and domain name services in order to "spoof" other computer networks and users.
(g) On giving any payment or credit card information via the web site to ensure that the same is accurate, complete and up to date and the user has the authority to give such information.
(4) Exclusion of warranties/limitation of liability.
(a) The user acknowledges that the information, software and other material accessible over the internet via the web site or web page may contain viruses, worms, trojan horses, cancelbots or other harmful of constructive components.
(b) The user must accept the services "as is" and "as available" without any warranty of any kind either express or implied.
(c) The North Ayrshire Council is not liable and will not be liable under any circumstances, for any direct, indirect, incidental, special, punitive or consequential loss or damages which result or may result from the users use of the web site or web page (included but not limited to deletion or loss of files, defects or delays in transmission or any failure of the web site or web page or for any purpose whatsoever or for any reliance use of information or services through the web site or web page.
(d) The foregoing warranties are in lieu of all other warranties, express or implied.
(5) Completion of forms
The completion of any application or form obtained form this web site, or the return of such form to North Ayrshire Council shall not constitute or imply the grant of any consent, permission or license whatsoever by the Council, nor shall it create any contractual relationship.
If any form or application is returned to the Council via the web site, it will not be registered as received until all required information has been submitted, including, if necessary, any required fee. Prior to communicating with this web site whether by application form or otherwise, the user will ensure that:-
